Terms of Use

Renky provides an online marketplace that allows:

• Renters to search for and discover rental properties;
• Landlords and property providers to create rental listings;
• Renters and landlords to communicate with each other;
• Users to save listings and searches; and
• Users to access rental-related information and resources.

Renky is not a landlord, property owner, property manager, real estate brokerage, or tenant.

Unless explicitly stated otherwise, Renky does not own, operate, manage, lease, sell, or control any property displayed on the Platform.

Any rental agreement or other transaction is between the relevant renter and landlord or property provider.

You must be legally capable of entering into a binding agreement to use the Platform.

If you are using Renky on behalf of another person, company, landlord, property manager, or organization, you represent that you have authority to do so.

You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations.

Certain features require you to create an account.

You agree to:

• Provide accurate and current information;
• Keep your account information up to date;
• Maintain the confidentiality of your login credentials;
• Not share your account with another person;
• Notify Renky if you believe your account has been compromised; and
• Accept responsibility for activity conducted through your account.

You must not create an account using false, misleading, fraudulent, or impersonating information.

Renky may suspend or terminate accounts that violate these Terms.

Landlords and other authorized property providers may create rental listings on Renky.

Listing information may include:

• Property description;
• Address or approximate location;
• Monthly rent;
• Bedrooms and bathrooms;
• Property type;
• Property size;
• Availability;
• Photos;
• Amenities;
• Pet policies;
• Parking information;
• Utilities;
• Furnishing information; and
• Other rental-related information.

Listing accuracy

The person who creates a listing is responsible for ensuring that all information is accurate, current, and not misleading.

Landlords must not:

• Advertise properties they do not have the authority to rent;
• Post false or misleading information;
• Misrepresent rental prices or fees;
• Use stolen or misleading photographs;
• Advertise properties that are unavailable;
• Create duplicate or substantially identical listings;
• Impersonate another landlord or property owner; or
• Use Renky for fraudulent or unlawful purposes.

Renky does not guarantee that any listing is accurate, complete, available, or legitimate.

Renky may review, moderate, restrict, edit, reject, suspend, or remove listings at its discretion.

Renky may take action where a listing:

• Appears fraudulent or suspicious;
• Violates these Terms;
• Contains misleading information;
• Has been reported by users;
• Contains prohibited content;
• Appears to be duplicated;
• Is no longer available; or
• May create legal, safety, or reputational risk.

Renky may use automated systems and human review to identify potentially problematic listings.

Automated detection does not guarantee that fraudulent or inaccurate listings will be identified.

Renky does not participate in rental agreements between users unless a particular Renky service expressly states otherwise.

Renky does not guarantee:

• That a property will be available;
• That a landlord is legitimate;
• That a renter is legitimate;
• That a renter will qualify for a property;
• That a landlord will accept a renter;
• That information supplied by another user is accurate;
• That a rental transaction will be completed; or
• That a rental property will meet a user's expectations.

Users are responsible for conducting their own due diligence before entering into a rental agreement or transferring money.

Users should exercise caution when communicating with landlords or renters.

Renky will provide safety information and may implement tools designed to identify or report suspicious activity.

However, Renky cannot guarantee that every fraudulent listing, message, user, or transaction will be detected.

Users should independently verify:

• The identity of the landlord or property provider;
• The existence and condition of the property;
• The rental terms;
• The identity of the person receiving payment;
• Any required deposits or fees; and
• The applicable tenancy laws and requirements.

Users should be particularly cautious of requests for:

• Payment before viewing a property;
• Cryptocurrency;
• Gift cards;
• Wire transfers;
• Unusual payment methods;
• Personal banking credentials; or
• Urgent payments designed to bypass normal verification.

If something appears suspicious, users should stop communicating, avoid sending money, and report the listing to Renky.

Renky may provide tools that allow renters and landlords to communicate.

Users are responsible for the content of their communications.

Users must not use Renky's communication features to:

• Harass or threaten others;
• Send spam;
• Send fraudulent messages;
• Distribute malware;
• Collect information for unlawful purposes;
• Discriminate unlawfully;
• Promote illegal activities; or
• Circumvent Renky's safety or moderation systems.

Renky may restrict or suspend messaging functionality where abuse or misuse is suspected.

Users may submit content including:

• Listing descriptions;
• Photos;
• Property information;
• Profile information;
• Messages;
• Reviews or reports, if supported;
• Comments; and
• Other materials.

You retain ownership of content that you submit.

By submitting content to Renky, you grant Renky a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, modify, translate, distribute, and otherwise use that content as reasonably necessary to operate, improve, promote, and provide the Platform.

This licence continues for as long as necessary for Renky to operate the Platform and maintain legitimate business, legal, security, and archival records.

You represent that:

• You own or have the necessary rights to submit the content;
• The content is accurate to the best of your knowledge;
• The content does not violate another person's rights; and
• The content does not violate applicable law.

You must only upload photographs and other materials that you have the right to use.

You must not upload:

• Copyrighted material without permission;
• Images stolen from other listings;
• Images intended to mislead users;
• Private or sensitive personal information without authorization; or
• Illegal or inappropriate material.

Renky may remove content that it believes violates these Terms or applicable law.

You must not use Renky to:

• Commit fraud;
• Impersonate another person;
• Post fraudulent rental properties;
• Misrepresent rental information;
• Harass or threaten users;
• Discriminate unlawfully;
• Scrape or copy substantial amounts of Platform content without permission;
• Circumvent technical restrictions;
• Attempt to gain unauthorized access;
• Introduce malicious software;
• Interfere with Platform operation;
• Reverse engineer the Platform except where permitted by law;
• Use automated systems to abuse the Platform;
• Collect user information for unauthorized purposes;
• Send spam;
• Promote illegal activities; or
• Violate applicable Canadian or provincial laws.

Landlords and renters are responsible for complying with applicable human rights, tenancy, housing, and anti-discrimination laws.

Renky does not permit discriminatory content or unlawful rental practices.

Users must not create listings, advertisements, messages, or other content that violates applicable human rights or housing laws.

Because housing laws can vary between provinces and municipalities, users are responsible for understanding the laws applicable to their particular rental transaction.

Renky may introduce paid services in the future, including:

• Featured listings;
• Listing boosts;
• Premium landlord accounts;
• Property management tools;
• Subscription plans; and
• Other promotional services.

If paid services are introduced, applicable prices, billing terms, renewal terms, and cancellation policies will be disclosed before purchase.

Unless otherwise stated, fees paid for promotional or subscription services are non-refundable after the applicable service has been provided, subject to applicable consumer protection laws.

Renky may change pricing or introduce new services with appropriate notice.

Renky may use third-party services including:

• Hosting providers;
• Payment processors;
• Authentication providers;
• Email providers;
• Analytics providers;
• Mapping services;
• Cloud storage providers; and
• Other technology providers.

Third-party services may have their own terms and privacy policies.

Renky is not responsible for the independent operation, availability, or policies of third-party services.

The Platform may contain links to third-party websites.

These links are provided for convenience only.

Renky does not control and is not responsible for third-party websites, content, products, services, privacy practices, or security.

The Renky name, logo, branding, website design, software, user interface, original content, graphics, and other Platform materials are owned by or licensed to Renky and are protected by applicable intellectual property laws.

Except as expressly permitted, you may not:

• Copy;
• Modify;
• Reproduce;
• Distribute;
• Sell;
• License;
• Reverse engineer; or
• Create derivative works from

Renky's intellectual property without prior written permission.

User-generated content remains subject to Section 9.

Your use of Renky is also subject to our Privacy Policy.

The Privacy Policy explains how Renky collects, uses, stores, protects, and discloses personal information.

Renky will handle personal information in accordance with applicable privacy laws.

For users in British Columbia, Renky will take into account applicable requirements under the British Columbia Personal Information Protection Act and other applicable privacy legislation.

By creating an account or using certain features, you may receive service-related communications such as:

• Account notifications;
• Listing notifications;
• Inquiry notifications;
• Security notices;
• Password and authentication messages; and
• Important Platform updates.

Marketing communications will be handled in accordance with applicable law.

Where Canadian Anti-Spam Legislation (CASL) applies, Renky will obtain the required consent and provide applicable identification and unsubscribe mechanisms for commercial electronic messages.

The Platform is provided on an "as is" and "as available" basis to the extent permitted by law.

Renky does not warrant that:

• The Platform will always be available;
• The Platform will be uninterrupted or error-free;
• Listings will be accurate;
• Listings will remain available;
• Users will be legitimate;
• Rental transactions will be successful;
• Content will be complete or current; or
• The Platform will meet every user's particular requirements.

Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable law.

To the maximum extent permitted by applicable law, Renky and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:

• Use of the Platform;
• Inability to use the Platform;
• Rental listings;
• Communications between users;
• Rental agreements;
• Property conditions;
• Fraud or scams committed by users;
• Loss of data;
• Third-party services; or
• Transactions between users.

Renky's total liability arising from your use of the Platform will be limited to the amount you paid to Renky for the relevant service during the twelve months preceding the event giving rise to the claim, to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Renky and its directors, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your violation of these Terms;
• Your violation of applicable law;
• Your user content;
• Your rental listing;
• Your interactions with other users; or
• Your misuse of the Platform.

Renky may suspend or terminate your account or restrict your access to the Platform if:

• You violate these Terms;
• You provide false information;
• You engage in fraudulent or suspicious activity;
• Your activity creates a safety or security risk;
• You abuse other users;
• You misuse the Platform; or
• Renky is required to do so by law.

You may stop using the Platform at any time.

Certain provisions of these Terms will survive termination, including provisions concerning intellectual property, user content, disclaimers, limitations of liability, indemnification, and applicable law.

Renky may modify, suspend, discontinue, or replace any part of the Platform at any time.

Renky does not guarantee that any particular feature will remain available indefinitely.

Renky may update these Terms from time to time.

When material changes are made, Renky may provide notice through the Platform or other reasonable means.

The updated Terms will become effective on the date stated at the beginning of the updated Terms.

Your continued use of Renky after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.

These Terms are governed by the laws applicable in the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

For users located in another Canadian province or territory, applicable mandatory local laws may also apply.

Before commencing formal legal proceedings, the parties should make reasonable efforts to resolve disputes informally by contacting Renky at the contact information provided below.

Nothing in this section prevents a person from exercising a legal right or remedy that cannot lawfully be waived or restricted.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary, and the remaining provisions will continue in effect.

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into the Platform, constitute the agreement between you and Renky regarding your use of the Platform.

Renky's failure to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision later.
